1. Overview

At Liambay (we, us or our), every product we sell comes with automatic consumer guarantees under the Australian Consumer Law (the ACL). Most products also carry a manufacturer’s warranty. This page explains both, and how to make a claim.

We do not offer a separate Liambay warranty in addition to those described below. Your rights are the statutory guarantees under the ACL and, where applicable, the manufacturer’s warranty.

2. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law

You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply for a reasonable period, which depends on the type of product, its price, how it is normally used and what the manufacturer or seller says about it. They are not limited to the length of the manufacturer’s warranty, and they cannot be excluded by us or by the manufacturer.

3. The consumer guarantees

Under the ACL, products we supply must:

  • be of acceptable quality, meaning safe, durable, free from defects and acceptable in appearance and finish;
  • be fit for the purposes for which goods of that kind are commonly supplied, and for any purpose you told us about before buying;
  • match their description and any sample or demonstration model;
  • come with clear title, so that you own them and no one else has rights over them; and
  • have spare parts and repair facilities available for a reasonable period, unless we told you otherwise.

4. Major and non-major failures

A failure is major if, for example:

  • a reasonable consumer would not have bought the product had they known about the problem;
  • the product is significantly different from its description or sample;
  • the product is substantially unfit for its normal purpose and cannot easily be fixed within a reasonable time;
  • the product is unfit for a purpose you made known to us, and cannot easily be fixed; or
  • the product is unsafe.

For a major failure, you may choose between a refund and a replacement, or keep the product and claim compensation for the drop in value. For a failure that is not major, we may choose to repair, replace or refund. If we do not fix the problem within a reasonable time, you may then choose a refund or a replacement.

5. Manufacturer’s warranty

Most electronics we sell, including appliances, TVs, computers, mobile phones, cameras, drones and games consoles, are covered by a manufacturer’s warranty. The period and terms vary by brand and product and are set out in the documents supplied in the product’s packaging, or on the manufacturer’s website.

The manufacturer’s warranty is in addition to your rights under the ACL. It does not replace them. A manufacturer’s warranty may require you to follow certain steps, such as registering the product or using an authorised repairer. Where the product fails within the warranty period, we will help you make a claim.

6. What is not covered

The manufacturer’s warranty, and our obligations under the ACL, do not generally cover defects caused by:

  • normal wear and tear;
  • misuse, accident, abuse or neglect;
  • failure to follow the manufacturer’s instructions;
  • unauthorised repairs, modifications or opening of the product;
  • water, liquid or physical damage, except where the product is advertised as resistant and was used as intended;
  • power surges or use with incorrect accessories or voltage; or
  • software, firmware or app problems caused by third parties.

This list does not limit your rights under the ACL where the problem is a failure of a consumer guarantee.

7. How to make a claim

  1. Contact us. Email us or use the details on our Contact Us page. Please give your order number, the product name and serial number, a description of the fault and, where possible, photos or a short video.
  2. Provide proof of purchase. Your order confirmation email is enough.
  3. We assess your claim. We will respond within 2 business days. We may ask you to carry out basic troubleshooting steps or to send the product for inspection.
  4. Remedy. If your claim is accepted, we will arrange a repair, replacement or refund as appropriate. Where the product has a manufacturer’s warranty, we may direct you to the manufacturer or its authorised service centre, and we will remain available to assist.

If you are returning a product because of a fault, we will pay the reasonable cost of return shipping. Please see our Refund & Returns Policy for the return process and refund timing.

8. Repairs and refurbished goods

Where we repair a product, we may replace it with refurbished goods of the same type, or use refurbished parts. Goods presented for repair may also be returned with data removed or reset. Please back up your data before sending us a device such as a phone or computer, as we are not responsible for loss of data during a repair.

9. Digital content and software

Software and games supplied with a product, and downloaded or digital products, are covered by the ACL guarantees where they are faulty or not as described. Some digital content may also be subject to the licence terms and support policies of the publisher.
